Circumstances
At least one seafarer is working without a valid medical certificate. One seafarer reported back pain on 2nd November 2024, and requested a hospital visit but according to the information received, the shipowner never arranged medical care. At least two seafarers are without valid employment agreements, which expired on 25th March 2025. Another two seafarers will have their contracts expire on 1st May 2025.
No repatriation plans have been arranged for any of these crew members, despite their repeated requests. The vessels tap water is brown and appears contaminated, raising serious concerns about the sanitary conditions onboard.

This is our respectful request for the removal of this record from the ILO public database on the grounds that all outstanding matters have been fully resolved in accordance with applicable international maritime labour standards, and the Owner has acted in good faith and with full commitment to the fair treatment of seafarers, as explained below.
1. Background of the Case
The case relates to an incident involving crew entitlements while the Vessel was in Libya, during a time of serious port instability and local administrative paralysis due to the armed conflict.
At the time, the crew did not initially report the issue directly to the Owner. Once the matter came to the Owner’s attention, immediate corrective actions were taken, including crew changes, salary settlements, and provisioning, all under difficult and unstable circumstances.
2. Owner’s Corrective Actions
Since the time of listing, the Owner fully cooperated with relevant maritime authorities and classification societies and also all outstanding crew claims have been settled in full, with no ongoing disputes or litigation. There is no active P&I claim or formal abandonment complaint pending before any tribunal or authority.

Submitted Documents are briefly as follows;
• Crew lists from April onwards.
• A breakdown of wages/wage slips for each crew member from April onwards.
• Crew contracts for anyone onboard from April onwards.
• Dates and reasons for crew leaving since April.
• Receipt of payment of those wages in full with no-deductions.
• The release documents (clearance forms) signed by the crew member.
3. Current Status of the Vessel
Our Client is a long-standing maritime company operating under high safety and labour standards. Throughout the process the Client maintained open communication with flag authorities and ITF. You may find the relevant correspondence attached to this email.
As of today there is no abandonment conditions on the Vessel following this isolated event and the the Vessel is fully operational.
We respectfully submit that maintaining this record no longer reflects the current operational standing of the vessel or its Owner, and will certainly result in irrevocable losses to the commercial viability of a vessel that is fully compliant and actively trading.
Therefore we respectfully request that;
1. The ILO undertake a review of Case No. 1365 in light of the remedial actions taken,
2. The record be removed from public listing on the ILO Abandonment Database,

Please be informed that regarding the case on board vessel VIVA 9156539, a total of seven seafarers have been arranged for repatriation, as per the attached. Additionally, the West of England Shipowners P & I club and the ITF have been closely monitoring the situation concerning the lack of drinking water and food. They have confirmed that there was adequate drinking water and food onboard, which was further supplemented by an additional delivery on 4th June. Furthermore, the crew advised that the wages were up to date. Please find the required information attached for your kind reference.
Therefore, we kindly request that the case be considered closed and removed from the abandonment database.
