I am writing to urgently request the intervention of your office in a severe case of crew abandonment involving five Indian seafarers currently stranded on board the vessel TANIN (IMO No. 8864347), flagged to Iran and currently located in Bandar Abbas, Iran.
The vessel is owned by *****. The five Indian nationals on board, comprising two Ordinary Seamen, one Cook, one Fitter, and one Oiler, have now been on the vessel for 14 months without wages, with expired employment contracts, and with no arrangements made for their repatriation. This situation continues to cause immeasurable physical, psychological, and financial distress to the crew and their families.
We understand that the recruitment was carried out by RPM Marine Pvt. Ltd., located at *****. The point of contact is ***** (Mob: *****). We are unable to locate any evidence that RPM Marine Pvt. Ltd. is registered under the RPSL scheme. Furthermore, the crew have reported that they each paid money to secure their positions, raising serious concerns regarding illegal recruitment practices.
The following provisions of the Maritime Labour Convention, 2006 (MLC 2006) are clearly and gravely breached in this case:
• Regulation 2.2 – Wages: The seafarers are not being paid at regularly for the work undertaken.
• Guideline B2.2.4 – Minimum Wages:The amounts stipulated in their contracts fall below the ILO minimum wage standard, which constitutes a serious violation of their right to fair remuneration.
• Standard A2.5.1 – Repatriation: The crew have been denied their right to repatriation at the end of their contracts, which expired several months ago. There is no indication of steps being taken by the shipowner or flag state to facilitate their return home.
• Standard A2.5.2 – Financial Security: The seafarers have not received any wages for 14 months
• Standard A2.1 – Seafarers’ Employment Agreements: Their employment agreements are no longer valid, yet they remain in service onboard in breach of both the terms of their original contracts and the MLC requirement for valid, current agreements.
• Regulation 1.4 – Recruitment and Placement: The involvement of an apparently unregistered recruitment agency, coupled with the confirmed payment of fees by the crew, points to non-compliance with national and international regulations governing ethical recruitment.
This is a clear case of abandonment, which has left the seafarers without maintenance and support, and has unilaterally severed ties with the crew.
Given the above, we respectfully request that the Directorate General of Shipping urgently:
1. Investigate RPM Marine Pvt. Ltd. for possible illegal recruitment practices and clarify their status under the RPSL system;
2. Engage with the Iranian maritime authorities to ensure the crew are repatriated without further delay;
3. Pursue action to ensure that full wages owed are recovered and paid to the seafarers;
4. Ensure that disciplinary or legal action is taken against the responsible parties, including the shipowner and any non-compliant recruitment agents.
