With reference to the email below concerning the abandonment of the vessel MARIN (IMO No. 8917895), we note that there is no record of any Indian seafarers having served on board this vessel in the Directorate General of Shipping’s E Governance system.

2. In light of this, it is challenging to examine the matter further without the details of Indian seafarers currently working on board the vessel. Therefore, we kindly request you to provide the necessary details of the Indian seafarers to help resolve this issue.

First of all, we would like to thank you and all people involved for the time taken in order to enhance the well-being of seafarers, managing IMO/ILO seafarers abandon database. France is fully convinced that such tool should be promoted among port state control authorities, in order to improve its credibility and efficiency.

As a brief answer to your request, and after reviewing the gentle answer submitted by Palau International Ship Registry, which we perfectly know that share with us the same goals of enhancing the well-being of seafarers, we kindly inform that the case is not closed from our side.

Indeed, we should point out that, despite what has been answered by flag state and published on ILO website beginning on July 2025, the situation on board this ship isn’t limited to non-payment of wages under the scope of Standard A2.5.2 § 2 c).
Unfortunately, several major non-compliances falling under the scope of Standard A2.5.2 § 2 a) on repatriation and b) on necessary minimum maintenance and support of seafarers, are still present on board.

As non-exhaustive example, we can share the following:
on July the 10th of 2025 ( thus after the date of answer of the Palau competent authority), an additional Port State Control inspection has been carried out following a new onshore complaint made by seafarers from the vessel. During this inspection, clear evidences have been gathered about the fact that:
- crew members were left by ship-owner without the necessary maintenance and support, being left without sufficient food and fuel in order to provide vessel with minimum power supply for light, ventilation, air conditioning system, cooking equipment and cold chambers operations. For several periods during daytime, it has been assessed that no power supply was available on board permanently.
- There was still several crewmembers with unpaid salaries for more than 2 months, and some of them with improper salary deductions.
- Several crewmembers are not repatriated and not provided without any answer to their request to ship-owner.

More generally, since January 2025 and also specifically since July the 10th of 2025, all crew members sent repetitive complaints regarding living conditions, lack of food (no meet, no fish, no vegetables), lack of water (only 5 litres per person per week), lack of ship's maintenance.
Finally, we just want to inform you about the fact that the insurance company, American club, as provider of financial security system meeting the requirements Standard A2.5.2, has been officially requested to act for a seafarer being on board for more than 11 months, with a contract expired since august 15th 2025.
In coordination with seafarer’s representatives and social services, French maritime Authority keeps a close look on situation of seafarers on board this vessel that is still detained since December 2024, for major deficiencies not limited to MLC matters.

It is also regrettable to note that the same ship-owner is also involved in another case of abandonment still open on the M/V MARIA imo 9041772, for which seafarers conditions must be even more worrying.
French competent authority can assure ILO that everything falling under its power will be done to ensure that the situation of all these seafarers is fully resolved.

In response to the below received eMail notification for the case of the vessel MARIN (8917895), please be advised that the outstanding debts to the crew have been settled.
The ITF representative ***** has been duly notified as of the 21st of July 2025 (enclosed correspondence).

We contact you as representative of French Port State Control administration.
From December last year, we face a situation in our port of Marseille with this vessel, that was, among others, detained with fake insurance certificates (P&I, Nairobi, bunker oil, MLC).
The vessel is at present under Port state control detention process and legal action from French justice for several major non-conformities related to technical aspects, environmental protection, and seafarer abandonment (unpaid salaries, indecent living and working conditions, several days without gasoil, physical abuse...), for which ITF is already involved. In addition, we already know that the two other vessels of the company encountered and still face similar situation in the far East and west Africa, where seafarers rights seem to be violated too, and already reported to unions. https://portal.emsa.europa.eu/web/thetis/current-detentions
The owner has two other vessels which are already in the IMO/ILO database :
M/V MARIN : Marin - Palau - 29 June 2024 / Marin - Palau - 1 June 2024
M/V MARIA : Maria - Palau - 1 July 2024
M/V MIRNA : Mirna - Palau - 1 February 2024

M/V MIRNA has been seized and sold in Honk Kong https://www.instagram.com/p/DDywXdxtEVI/ - M/V MARIA is still blocked in Nigeria coast and as far as we know, ITF is trying to find a solution for crew members of these vessel.

For M/V MARIN, at the time of the first inspection, the ship was not provided with any valid insurances. The Lebanese Al-Bahriah insurance certificates found on board were not valid anymore, for non-payment since July 2024.At the time of the second follow-up inspection 07/01/2025, the master of the ship gave us two sets of insurance documents.The first insurance was a Russian company named AMT insurance issuing ship Wreck, Bunker oil pollution and MLC insurances. AMT insurance certificates are not valid anymore for non-payment since February 2025. The second insurance was Sirius Mutual P&I Association Club, a Mississippi US based company. After investigation with Mississippi Authorities, it clearly appeared that such company was not authorised to act as insurer. Cease and Desist Order has already been issued by Mississippi Insurance Department and FBI involved to stop company activities.

Beginning of March 2025, another insurer named Maritime Mutual Insurance Association Limited has been provided. Then, at the beginning of July 2025, a fifth insurance issued by American Club IG P&I has been provided for all mandatory insurances as stated by the owner but this is not clearly established.

The situation of abandonnement is still going on now in july 2025. Some crew members have their contracts expired and they have to be repatriated.

For all this elements and reasons, we apply to create an abandonnement case on the IMO/ILO website.

3 July 2025: France

Crew cannot go outside the ship because the shipowner is taking mesures to go other, access to water supply 5 liters by seafarer by week (insufficient compared to WHO rules), food supply, communications to family is very limited. There were violence by officers on mates. Vermins and cockroaches found in galley. Untreated sewage is put in ballast mixed with sea water, sewage treatment system out of order. Lack of gasoil during several days. Invalid MLC and P&I insurances from 29/11/2024. At 01/07/2025 the ship is insured by American Club P&I.
